General Requirements
Original Signature(s) – ORS 93.804(2)
All signatures and notary acknowledgements must be original.
Document Title(s) - ORS 205.236 and ORS 205.234(1)(a)
The type of transaction, clearly labeled. A document may contain multiple titles. Each title must be clearly distinguishable to enable the recording clerk to index the document in the appropriate record.
Names of the Parties - ORS 205.234(1)(b)
The names of all parties to the document.
Return To - ORS 205.180(4)
The name and address of the person to whom the document will be returned.
Consideration – ORS 93.030
The true and actual consideration paid. Required on documents conveying or contracting to convey fee title.
Tax Statements – ORS 93.260
The address where tax statements will be sent. Required on documents conveying or contracting to convey fee title.
Font and Paper Size Requirements – ORS 205.232
All text (typed, written, or printed) must be 10-point type or larger. This requirement applies to all pages of the document.
Paper should be legal (8.5” x 14”) or letter (8.5” x 11”), but cannot be larger than 14 inches long and 8.5 inches wide and of sufficient quality for recording photographically (ORS 205.232). We require a 1.5 inch tall by 4 inch wide space for our recording label on the first page of every document.
Non-Standard Fee – ORS 205.327
When a recordable document is presented for recording and it does not comply with the requirements of ORS 205.232 or 205.234, the document will be recorded, however, will be charged an additional $20 non-standard penalty fee.
Re-Recording – ORS 205.244
If a document is being re-recorded to make a correction, the following re-recording certificate text is required to be on the first page:
“Re-recorded at the request of ______________ to correct ____________. Previously recorded in book __________ and page ___________, or as fee number ___________.”
Conveyances to Public Entities
ORS 93.808
All instruments conveying title or interest to the State of Oregon or to a county, city or other political subdivision in this state must include an indication of approval of the conveyance by the state or the political subdivision accepting title or interest. As a matter of County policy, this requires the receiving entity to include a statement approving the conveyance, signed by an authorized signer. The signature is not required to be notarized.
ORS 311.411
A certificate of taxes paid from the Lane County Assessor’s office is required to be attached to most instruments recorded to convey real property to a public entity. The certificate must be dated the same day it is recorded.
